Dear Mr. Maughan,
Good morning.
It has ten (10) days since I sent you the e-mail dated July 8, 2013 which you
have failed to timely respond, so to make sure that you receive my e-mail, again,
I am sending you a copy of my e-mail to you dated July 8, 2013 with subject :
MAUGHAN REFUSED TO RETURN MY ORIGINAL ERES EDUCATIONAL
CREDENTIALS. You know I have fervently and continously requested that these
original" ERES" documents be returned to me with signature of certain Ms Anna
Hernandez, the examination analyst. This request is shown in the last paragraph of my
letter to Ms Debbie Zuccala dated September 6, 2012, where I wrote the following:
" In addition, had you been punctual to respond to my e-mail I could have asked
and you could have explained to me why a five-year Bachelor of Science in
Management Engineering course whose records have been with my application
could not merit a 6 educational point requirement for GRADE 1 WWTP OPERATOR EXAMINATION. As you could see from the educational records, I have studied subjects dealing with engineering mathematics, physics and chemistry. The course have subject studies on civil, mechanical ,electrical and chemical engineering reinforced with a great deal of business management subjects. Just in case, the 5-year BACHELOR OF SCIENCE IN MANAGEMENT ENGINEERING course credentials or records that I have sent to you together with my application did not merit a 6 point educational point, then, may I request that the same be returned to me with comments and annotations so that I may have a chance to seek a professional third party opinion about the matter. "
If you wish to read the complete copy of the letter to Ms Debbie Zuccala dated September 6, 2012, You could read it here .
Now since Mr. Wes Wilkinson and most respectfully, you, Mr. Maughan have determined that I need to submit more credentials like transcripts, it follows that you have
determined that the educational credentials from "ERES" you have in your possession
right now did not meet the minimum six(6) educational point requirement for
Grade 1 operator certification examination. Then, please put your signature on it together with the signatures of Ms Anna Hernandez and Mr Wes Wilkinson, to show that the three of you have conscientiously and prudently examined those "ERES" documents, and took pride in signing those documents to show the public that you believe that what
you did is right in determining that those" ERES" documents could not merit the
minimum six(6) point educational requirement for Grade 1 operator certification
examination. Then, please return them back to me, the original copy, as soon as you can so that I may be able to seek a third party opinion about the matter. May I respectfully inform you that your refusal to return to me those documents since
September 6, 2012 up to this date, you have deprived me of the chance
to have those original documents examined by an independent third party which could have advised me on what is the course of action to take given these circumstances. Delay on your part have caused me almost year of painful experience of willful neglect of duty, discourtesy, conspiracy to confuse me, misrepresentation, wrongful denial of application, employee hiding after commission of a erroneous act from your employees and from you as well. I wanted to reiterate, that I need those original ERES Educational credentials, not an exact copy of those documents back.
Please respond in ten (10) days.
Yours faithfully,
Antonio L. Buensuceso

SUBJECT: MAUGHAN REFUSED TO RETURN MY ORIGINAL ERES
EDUCATIONAL CREDENTIALS
Fact finding and information gathering being pursued by way of
an appeal under the Freedom of Information Act, 5 U.S.C. § 552.
Dear Mr. James Maughan,
Good morning.
Please send me back the original copy of my educational credentials covering the
Bachelor of Science in Management Engineering as evaluated by ERES (Educational
Records Evaluation Service, Sacramento, Ca ) .
Since, from your e-mail below, you have included yourself as one of those who have
examined the educational credentials as evaluated by ERES and determined that those
documents could not merit the minimum six(6) educational points requirement for
Grade 1 operator certification examination. Then, show your signature, together
with the signatures of Ms Anna Hernandez and Mr. Wes Wilkinson to show proof
that all of you have thoroughly, prudently and conscientiously examined and found
that those mentioned documents from ERES could not merit the six(6) educational
requirement for Grade 1 operator certification examination.
With all due respect, I want to let you know that I profusely object to your statement
on the third paragraph of your e-mail shown below that you think that you have
responded to all my questions. This is ridiculous and outright irresponsible statement
from you. On the contrary, may I remind you, that there are a lot of them, and I will
name one of them:
Who is the mystery employee who opened the certified mail dated May 21, 2013
addressed to the Agency Administrator of the California Water Resources Control Board?
The link of possible suspects as my records showed, started with Mr. Andrew Cooper,
then Mr. Wes Wilkinson, then most likely, you, Mr. James Maughan due to the undisputed fact that you maliciously claimed that you are the Agency Administrator.
Meanwhile, will you please send me back the original copy of my educational
credentials of the Bachelor of Science in Management Engineering as evaluated
by ERES which I have submitted to Ms. Debbbie Zuccala, which was later analysed
by Ms. Anna Hernandez and Mr.Wes Wilkinson and just recently by you. And, please
dont forget to affix your comment and signature thereon, to show proof that you have
examined it and determined that it could not merit the six(6) educational point requirement for Grade 1 operator certification examination.
Please write or attach all your comment on that document . Again, please do not
forget to affix the signatures of Ms. Anna Hernandez, Mr. Wes Wilkinson and of course, your signature, most importantly.
May I be allowed to present other related concerns and/or issues on my coming e-mails. Otherwise, you may wish to inform me to write directly to Mr. Tom Howard, which I would humbly submit at an instant notice.
I will appreciate your favorable response.
Thank you very much.
Yours faithfully,
Antonio L. Buensuceso
MAUGHAN E-MAIL dated July 5, 2013
Maughan, James@Waterboards Jul 5 (1 day ago) July 5, 2013
to me, jun.benefits
Mr. Buensuceso, I am sorry it has taken this long to respond to you. I have check with my staff and all I can say concerning the document that I sent you by certified mail; it is the same exact document that you sent us. You will notice that there is as “State Water Resources Control Board” Date stamp dated July 19, 2012 on the document. We have sent back to you exactly what you sent to us.
I and my staff have reviewed all the documents that you have sent us. We do not dispute the validity of any of the documents. We do not question the ERES documents and what they state, the document just lack the detail we need to account for the proper number of education points. Therefore, we have asked for several times and continue to request that you supply us with specific classes that you have taken (usually supplied by transcripts), so that we can account for the proper education points.
Mr. Buensuceso, at this point I think I have responded to all your questions. It is up to you how you would like to proceed with your application. I hope that if you still want to apply to take the test that you will supply us with your transcripts. I wish you the best in whatever you decide to do from this point further.
James Maughan
Assistant Deputy Director, Division of Financial Assistance
