CRIMES COMMITTED TO AN ELDERLY IS PUNISHED EVEN MORE SEVERELY IN CALIFORNIA
$55 REFUND THEFT AND $40 MISAPPROPRIATION OF MY CERTIFICATION APPLICATION FEE AND CONCEALING EVIDENTIARY DOCUMENT BY WILKINSON ARE ACTS LIKEWISE BY THE CSWRCB AND BY ALL OF YOU WHO ARE CONSPIRING WITH HIM ARE CRIMES COMMITTED TO AN ELDERLY PERSON.
Dear Mr. Wes Wilkinson and ALL:
May I most respectfully inform you, I am more than 65 years old, and the crimes you had committed against me shall be punished even more severely by virtue of PC 368.
PC 368 states that a “person who knows…that a person is an elder or dependent adult and who…willfully causes or permits any elder or dependent adult to suffer, or inflicts thereon unjustifiable physical pain or mental suffering… [is guilty of a crime].”
Under Penal Code 368 PC, California law defines the crime of elder abuse as physical or emotional abuse, neglect, or financial exploitation of a victim who is 65 years of age or older. The offense can be prosecuted as a misdemeanor or a felony, and is punishable by up to 4 years of jail or prison.

AGAIN:
This evidence, among others which I have discussed, why you, Mr. Wilkinson and ALL, most probably agreed, consented and conspired with one another and let Mr. Wilkinson wrote and prepared the certified mail dated 18 February 2014 items 2 and 3 below, signed by Mr. Howard, The Executive Director, CSWRCB, EXPRESSLY CONSENTING TO IT, where the letter envelope, shown in item 1 below, obviously written that the letter originated from your office (Wilkinson) and not from the office of the executive director, Mr. Tom Howard, which remained not objected meaning you do not have substantial proof and/or argument to present to overturn the allegation. You (Wilkinson) are a learned man being a holder of a Bachelor's degree in Accounting and Associate degree in Business Administration and has worked for the State of California for over 20 years and has been the Manager of the Operator Certification Unit for over 7 years, so I am perplexed why despite having an excellent credential and prestigious position fitted to persons of high honor and integrity, you kept on hiding behind other peoples' identity. Be him or her your subordinate or your superior, you put their necks each one of them on the chopping block sparing yours and I am even more puzzled despite their higher positions than you have, a position of multitude of sterling qualifications and a matured and revered character, why are they allowing you to do these nasty acts to them, promoting and instigating impliedly suggesting such illicit conduct intentionally, deliberately and voluntarily. Why do the CSWRCB let one rotten egg spoil the whole image and reputation of the agency in a long span of ten (10) years or even more, if collectively, you ALL will not cease your improper conduct? I do not want to write about their motives which are in the public minds these times. For now, I would just wait for the police and FBI to think, analyze, evaluate and deduce it in most probably 100% accuracy.
Anyway, on account of item 4 below, where you wrote:
"Please note that you currently have a credit of $55 on file with the OCC. If you would like a refund of the $55, please send a refund request to: " YOU, Mr. Wilkinson,
"If you do not request a refund, your credit of $55 will remain with the OCC."
I had requested and demanded that the amount $55 credit be refunded to me as soon as possible without prejudice to the full amount of $95 full refund of my operator certification application fee, see item 5 below, which I am steadfastly demanding from you. Meaning that the remaining $40 of my operator certification fee which you misappropriated shall be a subject of my inquiry under the freedom of information act.
In law, misappropriation may be defined as "[t]he unauthorized, improper, or unlawful use of funds or other property for purposes other than that for which it is intended." You might have committed misappropriation and maybe liable to criminal prosecution for a form of theft as well as disciplinary action.
Please consider these facts of the crimes committed:
Ownership.
I am the victim of the crime and I have the "possessory interest" in the $55 refund and the $40 misappropriated operator certification fee.
Wrongful taking.
I have not given consent to the taking of the $55 refund instead I am demanding the return of that amount to me and the $40 examination fee, since I did not formally file the application for examination as evidenced by the form I filled up up was for a certification (see Item 5) and not for examination.
Carried away. The CWCRB and you, Mr. Wilkinson, and co-conspirators had taken away those amounts from me.
Intent to permanently deprive. The CWCRB and you, Mr. Wilkinson, together with the co-conspirators had intended to permanently deprive me of my money.
Please Mr. Howard, Ms. Haven, Mr. Bishop, Mr. Maughan, Ms. Gordon, Mr. Cooper, Ms. Hernandez/Perez, Ms. Zuccala, Mr. Okamoto, Ms. Biggins, Mr. Wilson and Ms. Valine, write to me why you should not be indicted on the charge of conspiracy to commit the alleged crimes. Failure to write to me your opposition to those assailed acts by CSWRCB and Mr. Wilkinson shall be understood that you are and shall remain consenting and conspiring with them.
May I most respectfully request you All, please write to me individually your withdrawal from the conspiracy as soon as you can or you may lose your chance if you withdraw from it later. However, by virtue of the information I reviewed (See ITEM 6 below JUNE 25, 2013 EMAIL FROM JAMES MAUGHAN SHOWING EMPLOYEE DESIGNATIONS ANSWERING AT LAST WHO IS THE LEGALLY MANDATED MANAGER OF DEBBIE ZUCCALA AFTER TORTIOUS ORDEAL OF 8 MONTHS),
I determined from the diagram that Ms. Zuccala, Ms. Hernandez/Ms. Perez and Mr. Cooper must not be included to be charged in the theft and misappropriation of criminal conspiracy complaint. Why? Because they, being subordinates to these managers, had to follow instructions from these managers and expectedly they had acted and are acting under duress and my detailed communications record show that though these subordinates are doing acts wrongfully, which I had filed complaints and provided comprehensive details about them to these managers, they are not being reprimanded and worse these managers are impliedly instigating or encouraging them to act as bad as what they have done to me but I am encouraging them to keep records if ever they have to prove that this kind of funds fraud similar to this, where no applicant victims excluding me, ever had mustered enough courage to complain for fear of reprisal from these managers such as imposing arbitrarily redundant requirements purposely to deny certification, which might be a normal practice encouraged and promoted by these managers to earn dirty revenues from this reprehensible endeavor for the Division of Financial Assistance and meticulously consider safely exposing these anomalies through the writ of qui tam and be a paladin in your own little way.
I repeat, Ms. Zuccala, Ms. Hernandez/Ms. Perez and Mr. Cooper, I am not inclined to include you in the conspiracy to commit theft and misappropriation charges against your agency and managers. Please save this email record for your protection. You need not write to me your withdrawal from the conspiracy because I understand the predicaments you've been through. Be safe. Sleep well. Stay sound, fit and healthy. Please do not worry. I shall come to your defense to avoid pointing the guilt on to anyone of you by your managers. However, please cooperate with the police and FBI authorities in case they received a tip from whoever he or she might be, about these anomalies and then, they found probable cause, then decided to come in and conduct investigations about this matter. And to whoever would send this crime info or tip to the police authorities, or the FBI, I would want to express my profound gratitude in advance.

Good morning.
May I, respectfully and with utmost humility, inform you that you are committing extreme mockery against
my person by doing acts I am not requesting you to do, and ignore those which I need you to be doing.
I attached my educational credentials on my e-mail dated June 25. 2013 as a proof of the Bachelor of
Science in Management Engineering educational credentials which is similar to the credentials you have
in your file.This educational credentials had already been examined first by Ms. Debbie Zuccala and then,
by certain Ms. Anna Hernandez and she, the latter, had already determined that the mentioned educational credentials did not merit the six(6) educational point requirement to be qualified to take the Grade 1 operator certification examination.. I categorically opposed her findings and steadfastly requested that the application
form and the educational credentials covering the Bachelor of Science in Management Engineering in forms attested by ERES (Educational Records Evaluation Service, Sacramento, CA) be send back to me with comments or annotations why it could not merit a six (6) educational points so that I might be able to seek a third party opinion about the matter. However, Ms. Debbie Zuccala, Ms. Anna Hernandez, Mr. Wes Wilkinson, Ms. Christine Gordon and the Office of Operator Certification willfully ignored my request And, just recently, Mr. Andrew Cooper withheld showing or sending me back my educational credentials.
Now, you are informing me that your staff have reviewed the information as regarding my educational
credentials as shown part of your e-mail, where you wrote : (from the e-mail shown below)
and just need the transcripts for the Management Engineering – Bachelor of Science Degree so
that we can give you all the credit that you deserve. Please send that as soon as you can."

Again I am sorry for any confusion I have caused you. I do know that Tom Howard would like you to communicate with me first. To help clear up who works for who. I have attached a partial Division of Financial Assistance Organization Chart. It show our Administration Section and show who supervisors whom. I have highlighted Wes Wilkinson, Christine Gordon, Debbie Zuccala and Andrew Cooper. You will see that Ms. Zuccala reports to Mr. Wilkerson who reports to Ms. Gordon.
You will notice that they all directly or indirectly report to me.
I hope this helps clear up some of your concerns.

This is ridiculous and appalling. I am not requesting for the credit that you can give. What matter to me most is your act of returning back to me copies of my educational credentials(original) with signatures of
Ms. Anna Hernandez and Mr. Wes Wilkinson, to show that both of them have prudently and conscientiously examined it and determined that it could worth not even half an educational point. Please send it ( original

May I, respectfully and with utmost humility, inform you that you are committing extreme mockery against
my person by doing acts I am not requesting you to do, and ignore those which I need you to be doing.
I attached my educational credentials on my e-mail dated June 25. 2013 as a proof of the Bachelor of
Science in Management Engineering educational credentials which is similar to the credentials you have
in your file.This educational credentials had already been examined first by Ms. Debbie Zuccala and then,
by certain Ms. Anna Hernandez and she, the latter, had already determined that the mentioned educational credentials did not merit the six(6) educational point requirement to be qualified to take the Grade 1 operator certification examination.. I categorically opposed her findings and steadfastly requested that the application
form and the educational credentials covering the Bachelor of Science in Management Engineering in forms attested by ERES (Educational Records Evaluation Service, Sacramento, CA) be send back to me with comments or annotations why it could not merit a six (6) educational points so that I might be able to seek a third party opinion about the matter. However, Ms. Debbie Zuccala, Ms. Anna Hernandez, Mr. Wes Wilkinson, Ms. Christine Gordon and the Office of Operator Certification willfully ignored my request And, just recently, Mr. Andrew Cooper withheld showing or sending me back my educational credentials.
Now, you are informing me that your staff have reviewed the information as regarding my educational
credentials as shown part of your e-mail, where you wrote : (from the e-mail shown below)

With all due respect, verbal communications would be even more painful with you on the other side of the line. As my written and fully documented e-mail communications showed, you are a person who has the propensity to misrepresent, cheat and lie. Despite the fact, that you have sent me just photo copy of my Bachelor of Science in Management Engineering credentials as evaluated by ERES without your signature, so with the signatures of Mr Wes Wilkinson and Ms Anna Hernandez and claimed that you have sent me all the originals and stated that, " We have nothing else to give you." as shown on your e-mail below, in other words, these are duly recorded and documented e-mail communications, yet, you are bold enough to cheat and lie, then EVEN more cheating and lying I could expect from you through phone communications as these are not recorded communications. Please excuse me, Mr. Maughan, there is no sense talking to you by the phone. Since, September 6, 2012, on my letter, last paragraph I have requested and demanded that the original copy of my educational credentials covering the Bachelor of Science in Management Engineering as evaluated by ERES (Educational Records Evaluation Service, Sacramento, Ca) be returned to me with signature of Ms Anna Hernandez initially, which later, since Mr Wes Wilkinson and you have checked it as well, I requested that Mr Wes Wilkinson and you signed it just the same. I wanted to categorically state that you have not send me yet the original copy of my educational credentials. With regard to this issue, It is worthwhile to inform you that Ms Debbie Zuccala willfully refused to reply, Ms Anna Hernandez failed to respond, Mr Wes Wilkinson ignored to reply, the Office of Operator Certification ignored to reply, then Mr Andrew Cooper withheld the information about this ERES educational credentials, then ran away and hide, then now you are telling me that you have sent all the original copy and you have nothing else to return. With all due respect, you are cheating. Since, September 6, 2012, I have drawn the line. I did not and will not send in any additional educational records. I do not intend to seek the complete or over all educational points that the Bachelor of Science in Management Engineering could make. I just needed the minimum six(6) educational points. It does not make sense that you needed to analyse transcript of records from schools and universities from the Philippines to come up to conclusion that I have met the required minimum six(6) educational point for WWTP operator certification examination. The evaluation of the transcript of records for this mentioned educational credentials have been well taken cared of by ERES for you. Besides, as my record and experience with your staff is to be considered, with all due respect, they are incompetent and irresponsible and cunning. At most, as I saw it, they would not know how to evaluate transcript of records from foreign countries as evidenced by their deeds, as exemplified on the next paragraphs and therefore letting your staff and you, analyse transcript of records is deemed to be a useless and futile exercise. See for yourself, again with all due respect, Ms Debbie Zuccala, considered my WWTP Operator Certification application for an application for WWTP Operator-in-Training Certification. These application forms are distinctly different from each other and when asked why, she refused to reply. The code of regulation said, that applications not in the correct forms shall be considered deficient and deficient applications shall not be processed but Ms Debbie Zuccala still processed my application though it is not in the correct form and therefore, deficient, and should not be processed. This proves Ms Debbie Zuccala's incompetence.That same application, though has already been found as an application for WWTP operator certification and not correct application for WWTP operator certification examination, but still Ms Anna Hernandez process it, though it was deficient. A violation of your own regulation done not once, but twice with express approval of Mr. Wes Wilkinson. This showed Mr. Wes Wilkinson and Ms Ana Hernandez collective incompetence. Second, Mr Wes Wilkinson and Ms Christine Gordon in conspiracy, both send me an e-mail on September 24, 2012 claiming each one of them is Ms Debbie Zuccala's manager with covert intention to confuse me and drive away culpability from Ms. Debbie Zuccala. Though they might be both managers for Ms Debbie Zuccala, prudence and courtesy and good judgment dictate that it would be very confusing for me to talk to two managers for the same person at the same time, especially so, when these two managers are avoiding accountability for Ms Debbie Zuccala deeds and/or omissions. Consequently, they have completely confused me. This proves that Ms Christine Gordon and Mr Wes Wilkinson are cunning. Third, Mr. Andrew Cooper, declared himself as the Freedom of Information Officer, then, withheld the information about the now controversial "ERES educational credentials" and when informed that he was replying to a letter not addressed to him and told that his act consisted "usurpation of authority," now, he is gone into hiding. This shows Mr Andrew Cooper gross misrepresentation and dishonesty. Fourth, as to the person who opened the the letter addressed to the Agency Administrator of the California Water Resources Control Board as my records showed the suspects might be from Mr. Andrew Cooper, then, Mr. Wes Wilkinson and then you, Mr. James Maughan. As you already knew, that letter was addressed to Mr. Tim Howard and not to you. With all due respect, with your deeds and/or omissions, which plunged me into deeper pain and misery, you became (pardon me for this word) a shame to the office of Mr. Tim Howard which you are trying to represent. This is gross misrepresentation cheating and dishonesty. Fifth, with your continuing reluctance to return to me original copy of my educational credentials as evaluated by ERES (Educational Records Evaluation Service, Sacramento, Ca) together with your signature and rest of signatures of Ms Anna Hernandez and Mr. Wes Wilkinson, you have effectively deny me of the chance to show that pieces of original document to a neutral third party and to seek their corresponding opinion or advice about this matter. This is suppression of evidential documents, deceit and dishonesty Again, I wanted to reiterate that If Ms Anna Hernandez, and Mr. Wes Wilkinson and you, most respectfully, Mr. Maughan strongly believe that you are right on denying the minimum six(6) educational point requirement on my educational credentials that is with you right now,(no transcript of records) for a Grade 1 WWTP operator certification examination, then, please do not hide it, and put your signature on it with pride and great honor to show the public that you have done the right thing. Otherwise, you have done something ridiculous and shameful.
