SUBJECT :  NINE-HUNDRED THIRTY-SIX (936) APPEAL AND FOLLOW-UP APPEALS

Dear Mr. Funston,

Good morning.

I got the screenshot from INFO 1, from your email on January 10, 2022  showing you wrote to me an email with an attached letter from Ms. Sobeck dated June 29, 2021 where from the last paragraph of that letter dated June 29, 2021

" If you would like information about re-applying for a wastewater operator certification examination or if have any additional questions not previously addressed, please contact Mr. Neal Funston at neal.funston@waterboards.ca.gov so that he may assist you. " 
 

May I most respectfully comment that this statement is one where you, Mr. Funston together with Ms. Sobeck are perpetuating the hatred you collectively from Ms. Zuccala up to all of you have on me being a Filipino and happened to be educated in a school from the Philippines. Why? Because UNTIL NOW ON YOUR TERM OF OFFICE, you are writing the same foolishness A CHICANERY, A STRATAGEM to re-apply for an examination I have not applied for since August 2012 until now. 

PLEASE WRITE TO ME A SUBSTANTIAL ANSWER WITHIN FIFTEEN DAYS WHY DO YOU KEEP ON WRITING THAT RE-APPLICATION  ACT, MEANING TO APPLY AGAIN FOR AN EXAMINATION THAT I HAVE NOT APPLIED FOR YET THE FIRST TIME? FAILURE ON YOUR PART TO PROVIDE A SUBSTANTIAL ANSWER SHALL BE UNDERSTOOD BY BOTH OF US THAT THIS IS AN ACT OF FOOLISHNESS AGAINST ME IN FURTHERANCE OF YOUR PURPOSE TO INSTITUTIONALIZE YOUR DISCRIMINATION ON ME BY CONTINUING  INTENTION TO INFLICT CONTINUING PAIN AND SUFFERING ON ME THROUGH MANAGERIAL IRRESPONSIBILITY.

DISCUSSION

THIS IS A TOTAL OF  NINE HUNDRED THIRTY-SIX (936) FROM AUGUST 2015 TO JUNE 2019 ALMOST FOUR (4) YEARS CONTINUING FOLLOW UP OF APPEALS FOR MR. HOWARD TO GRANT OR DENY THE MINIMUM SIX (6) EDUCATIONAL POINTS REQUIREMENTS FOR ME TO APPLY FOR AN EXAMINATION WHERE MR. HOWARD DUE TO HIS DELIBERATE NEGLIGENCE AND EFFORTS TO INSTITUTE DISCRIMINATION ON ME THROUGH MANAGERIAL IRRESPONSIBILITY TO INFLICT CONTINUING PAIN AND SUFFERING OPTED NOT TO MAKE DECISION OR GUIDE ME THROUGH THE APPEAL PROCESS OR EVEN AT LEAST ACKNOWLEDGE  IT.  ALTHOUGH HIS EMPLOYEES BEFORE HIS EYES COMMITTED WRONGFUL ACTS OF CONTINUING DENIAL OF MY APPLICATION SINCE AUGUST 2012 UNTIL NOW .
 
FIRST, BEING MY APPLICATION DOCUMENTS ARE DEFICIENT MS. ZUCCALA AND MS HERNANDEZ PROCESSED IT IN CONTRARY OF THE REGULATIONS MANDATING DEFICIENT APPLICATIONS SHALL NOT BE PROCESSED TWICE. 

SECOND, BOTH EXAMINERS MENTIONED PROCESSED THE SAME APPLICATION WITHOUT GIVING ME THE CHANCE TO CORRECT THE DEFICIENCIES THEY FOUND ON MY APPLICATION VIOLATING THE PROVISION  OF THE REGULATIONS PERTAINING TO NOTICE TWICE. 

THIRDLY, THE STATE WATER BOARD CONTINUING DENIAL ON ME THE CHANCE TO APPLY TO TAKE AN INITIAL EXAMINATION  BY INSISTING UNTIL NOW THAT I SHOULD RE-APPLY EVEN IF I HAVE NOT FILLED UP AN APPLICATION FOR IT YET.  HOW COULD I RE-APPLY WHEN I HAVE NOT APPLIED FOR IT YET? HOW COULD I RE-APPLY WHEN I HAVE NOT APPLIED FOR IT THE FIRST TIME? 

HIS EMPLOYEES CONCERNED DID WRONGFUL ACTS BUT MY RECORDS SHOW THEY NEVER GET REPRIMANDED OR DISCIPLINED BY THE STATE WATER BOARD AND WORSE YOU AND YOUR AGENCY  ACCORDING TO MY RECORDS ARE INSTIGATING THEM TO DO IT AGAINST ME AS IN HOWARD RETIRING WITH RETIREMENT PACKAGE IN TACT WITH HIM AND NOW AIDING HIM AND THE REST OF HIS CONCERNED EMPLOYEES TO HIDE TO AVOID PROSECUTION OF THEIR ALLEGED CRIMES AND WRONGFUL ACTS AND OMISSIONS.

WHY NOT IN AUGUST 2015  AFTER AGONIZING THREE YEARS DEALING WITH MS. ZUCCALA, MS. HERNANDEZ, MS. GORDON, MR. WILKINSON, MR. COOPER, AND MR. MAUGHAN, WHEN I STARTED MY APPEAL FOR HIM, MR. HOWARD, TO GRANT OR DENY  ME A MINIMUM SIX (6) EDUCATIONAL POINT, HE SHOULD HAVE ACKNOWLEDGE MY APPEAL, STUDY IT THEN RENDER HIS DECISION RATHER THAN KEEPING HIS SILENCE ABOUT IT UNTIL NOW LEAVING MY APPEAL HANGING IN BALANCE? AND PREFER TO RUN FLEE AND HIDE  IN THE STATUTES OF LIMITATIONS BETTER THAN GIVING RESPECT TO ME, A FILIPINO.

IT IS IMPORTANT THAT HE MAKES HIS DECISION FAVORABLE OR NOT ON MY APPEAL SO THAT I MIGHT BE ABLE TO CHOOSE WHETHER TO PROCEED WITH THE APPLICATION OR WITHDRAW IT SOONER SO THAT I CAN MOVE ON TO OTHER PRODUCTIVE ENDEAVOR AND USE MY TIME  NOT IN DEFENDING MYSELF AGAINST YOUR ATROCITIES WHEREIN YOU DO KEPT ON DOING YOUR DISCRIMINATORY ACTS AND OMISSIONS, REFUSES TO GIVE ME RESPECT AND OPTS  TO RUN, FLEE AND HIDE, AND WRONGLY SEEKS REFUGE IN THE STATUTES OF LIMITATIONS TO SAVE YOU FROM GUILT RATHER THAN EXTENDING YOUR HELP ON ME, AN INDIGENT ELDERLY FILIPINO. THE STATUTE OF LIMITATIONS SHALL NEVER BE A SAFE HAVEN TO WRONGDOERS BEING PURSUED CONTINUOUSLY  FAITHFULLY , RELENTLESSLY.


So please Mr. Funston stop discriminating me, degrading me down to a pea brained Filipino that you would want me appear when you continually affirmed to rate me zero (0) on my ERES educational credentials from 2012 up to these days which in your mind I would not be able to interpret meanings behind the statements you are writing. May I most respectfully remind you that I am equally intelligent as you are.

This treatment born out of  prejudice you all collectively have against me, a Filipino did not happen once but have been institutionalized by all of you and your agency and permeates all throughout my personal experience dealing with all of you through email communications, including regular and certified mails from 2012 up to the present from Ms. Debbie Zuccala up to you, MR. FUNSTON AND MS. SOBECK  tattered with contemptuous disrespect, cheating, lies, false pretenses and deliberate negligence. Why? Because of myself being one born as a Filipino and educated in a school from the Philippines? The same primordial cause you did put a circular discriminatory mark around the word "PHILIPPINES" on the ERES educational document you are hiding since 2012 until now.

This led me to believe that this arbitrary and capricious decision and actions and omissions by the CSWRCB/OOC only show the intensity of discrimination all of you, collectively have against me, for being a Filipino and happened to be educated in a school from the PHILIPPINES.
