SUBJECT :  $55 REFUND DEMAND WITHOUT PREJUDICE TO THE FULL AMOUNT REFUND OF $95 CLAIM FROM YOUR OFFICE                            

Dear Mr. Wes Wilkinson,

Another evidence, among others which I have discussed, why you most probably wrote and prepared the certified mail dated 18 February 2014 items 2 and 3 below, signed by Mr. Howard where the letter envelope, shown in item 1 below, obviously written  that the letter originated from your office and not from the office of the executive director, Mr. Tom Howard.

Anyway, on account of item 4 below, where you wrote:

 "Please note that you currently have a credit of  $55 on file with the OCC. If you would like a refund of the $55, please send a refund request to: " YOU, Mr. Wilkinson, 

            

  "If you do not request a refund, your credit of $55 will remain with the OCC."

I demand that the amount $55 credit be refunded to me as soon as possible without prejudice to the full amount of $95 full refund of my operator certification application fee, see item 5 below, which  I am demanding from you. Meaning that the remaining $40 of my operator certification fee which you misappropriated  shall be a subject of my inquiry under the freedom of information act.   In law, misappropriation may be defined as "[t]he unauthorized, improper, or unlawful use of funds or other property for purposes other than that for which it is intended."  You  might have committed misappropriation and maybe liable to criminal prosecution for a form of theft as well as disciplinary action. Are there sacred cows in the CWRCB? 

MOREOVER, IF YOU THINK YOU CAN TAKE REFUGE ON STATUTE OF LIMITATIONS AS A LEGAL DEFENSE TO DISCOURAGE ME IN PURSUING GOOD FAITH NEGOTIATIONS WITH YOU, MAY I MOST RESPECTFULLY INFORM YOU THAT IN ACCOUNT OF YOUR UNABATED CONTINUING VIOLATION IN MULTIPLE WRONGFUL ACTS, FAILURES TO ACT, OR DECISIONS SUCH THAT THE LIMITATIONS PERIOD BEGINS TO RUN ON THIS COLLECTED MALFEASANCE ONLY WHEN THE DEFENDANT, YOU MR. WILKINSON or WHOEVER HE MAYBE,  CEASES YOUR or HIS IMPROPER CONDUCT. SINCE YOU HAVE NOT STOPPED YOUR IMPROPER CONDUCT SINCE WAY BACK 2012 UNTIL NOW; HENCE, ANY  LIMITATION PERIOD TO FILE  ANY SUIT AGAINST YOU or HIM HAD NOT BEEN STARTED YET .

May I most respectfully remind you that please respond properly and responsibly.

Please do not subject Mr. Tom Howard to further humiliation among his peers, subordinates and the public,  when as an executive director it is his duty to execute corrective managerial action on your unabated continuing misconducts but he relentlessly renegades on this solemn obligation.

From page 2  last  two (2)  paragraphs, you, Mr. Wilkinson,  while hiding behind the identity of Mr. Tom Howard wrote, "Please note that you currently have a credit of  $55 on file with the OCC. If you would like a refund of the $55, please send a refund request to: " YOU, Mr. Wilkinson, 

              "If you do not request a refund, your credit of $55 will remain with the OCC."

The $95 application fee is intended for operator certification not for examination which the form below clearly conveyed.

Note : This form is impressed upon me that you enclosed in your email dated  May 31, 2013 while hiding behind the identity of Mr. Andrew Cooper. But the fact is, though you expressly wrote it is enclosed,  you did not enclose or include this form among the attachments for the simple reason that this form clearly shows your probable criminal liability pertaining to misappropriation.
